Simon Johnson's petition for writ of habeas corpus was denied without prejudice on the ground that he had not exhausted his
available state remedies in the Florida courts. Inasmuch as it appears that no Florida court has ruled on his claim that he
was denied a right to appeal, we affirm the denial of the petition, even though he has exhausted his state remedies as to
the other grounds stated therein. In addition to the claim that he had been denied a right to appeal, Johnson's petition contained the following allegations:
(1) he was interrogated without the presence of counsel; (2) he was held incommunicado and denied counsel of his choice; (3)
his court-appointed counsel was ineffective; (4) the verdict was contrary to the evidence; and (5) the prosecution made knowing
use of perjured testimony.
